A class action lawsuit filed on March 31 in federal court in San Francisco claims Perplexity AI has been routing user conversations to Google and Meta through hidden trackers embedded in its code. The trackers allegedly activate the moment you log in and transmit chat data in real time — including conversations made in Incognito mode.

The plaintiff, a Utah man identified as John Doe, says he shared personal financial information — taxes, investments, family finances — believing those conversations were private. According to the complaint, they weren't. Perplexity says it hasn't been served the lawsuit yet.

This matters for AI search visibility, and not for the reason you'd expect.

AI Search Is Real Infrastructure Now

A year ago, nobody filed lawsuits over AI search privacy because nobody used AI search for anything that mattered. You don't sue over a novelty. You sue over something that handles real data from real people making real decisions.

This lawsuit is evidence that AI search has crossed from experiment to infrastructure. People are using Perplexity to research financial decisions, find local services, compare products. The kind of high-intent queries that used to live exclusively on Google.

When the platform handling those queries faces a class action over data practices, it tells you something about the stakes involved. AI search isn't a side project anymore. It's where decisions happen.

The Privacy Angle for Business Owners

Here's the part that connects to your business. The lawsuit alleges tracking scripts collect data about what users search for and share it with Google and Meta's advertising infrastructure. If that's true, it means user queries on Perplexity — "best dentist near me," "reliable roofer in Phoenix," "accounting firm for small business" — could be feeding the ad targeting systems of the two largest advertising platforms on earth.

That creates an interesting dynamic. Even if your business isn't running ads, the queries people ask about your industry on AI platforms could be informing the ad ecosystem. The line between AI search and paid advertising is blurrier than anyone assumed.

What This Changes

For business owners thinking about AI visibility, three things are worth noting:

AI search handles sensitive queries. People trust these platforms enough to ask about finances, health, and major purchases. That means the businesses AI recommends carry implicit trust. Being recommended by AI is becoming a credibility signal, not just a traffic source.

Privacy regulation is coming to AI search. This is the first major class action targeting an AI search platform's data practices under California's CCPA. Win or lose, it sets the agenda. More transparency, more compliance requirements, and potentially more controls over how AI platforms share user data. Platforms that clean up their act will likely earn more user trust — and more usage.

Perplexity isn't going away. Lawsuits didn't kill Facebook. They didn't kill Google. They made both companies tighten their policies and grow bigger. Perplexity will likely do the same. The platform that survives legal scrutiny comes out with more legitimacy, not less.

The Bottom Line

AI search platforms are handling real queries from real people about real money. Lawsuits confirm it. Regulations will follow. None of that changes the fundamental question for business owners: when someone asks AI to recommend a business in your industry and your city, does your name come up?

The platforms will sort out their privacy practices. Your job is making sure you're visible on them when they do.
